VirnetX Optimistic About Prevailing In Apple Appeal

ZEPHYR COVE, Nevada.,– July 1, 2013 – VirnetX™ Holding Corporation (NYSE MKT: VHC), an Internet security software and technology company, announced today that on July 1, 2013, Apple Inc. filed a Notice of Appeal, appealing, inter alia, the $368 million damages award against Apple for infringement of four VirnetX patents.  In February 2013, after a jury trial and post-trial motions, the United States District Court for the Eastern District of Texas, Tyler Division, entered a final judgment against Apple, finding four VirnetX patents infringed and valid, and awarding VirnetX damages of $368 million, pre-judgment interest, post-judgment interest, and post-verdict damages.  Apple filed a motion to alter or amend the judgment in March 2013, but the District Court denied that motion last month.  Apple has now appealed to the Court of Appeals for the Federal Circuit.
